Terms and Conditions

1. Who we are

Yayika is a digital women’s wellness platform operated by Edgar Apolonio Aguilera ("Yayika", "we", "our"), domiciled in Mexico. The main website is yayika.com.

Yayika offers educational content about the menstrual cycle, women’s productivity and wellbeing — through digital memberships granting portal access, content modules, a symptom tracker and an anonymous community.

2. Eligibility

• You must be 18 or older to use Yayika.
• By accepting these Terms you declare that you meet the required age and legal capacity to enter this contract.
• Yayika is available worldwide except in jurisdictions where it is expressly prohibited.
• One account per person. Sharing credentials is not allowed.

3. Membership and payments

3.1 Available plans

• Seed: $5 USD/month
• Warrior: $10 USD/month
• Diamond: $18 USD/month

3.2 Trial period: All plans include a 7-day free trial. No charge is made during the trial. When it ends, the subscription activates automatically.

3.3 Automatic renewal: Memberships renew automatically each month on the billing date. You can cancel anytime before the next renewal date.

3.4 Taxes: Prices are in USD. Applicable local taxes are the subscriber’s responsibility according to her jurisdiction.

3.5 Payment processor: Payments are processed by Stripe, subject to its own terms. Yayika does not store credit card data.

4. 30-day guarantee and refunds

• To request a refund: go to the portal → "30-day Guarantee" section, or write to hola@yayika.com.
• The refund is processed within 3-5 business days to the original payment method.
• When the refund is processed, portal access is cancelled immediately.
• Membership pause: available once per calendar year, at no cost.

5. Portal access and content

• Portal access is personal and non-transferable.
• Yayika reserves the right to update, modify or remove content without notice.
• Portal content is protected by copyright. Its reproduction, distribution or commercial use without written authorization is prohibited.
• Yayika may temporarily interrupt the service for maintenance. Advance notice will be given when possible.

6. My Confessional and The Circle — Community

6.1 Content responsibility: You are fully responsible for everything you post in The Circle. Yayika does not review or moderate content in real time.

6.2 Prohibited content: It is strictly forbidden to post:

• Full names, identifiable data or private information of third parties
• Hate, violence, discrimination or harassment content
• Explicit sexual content
• Medical information presented as diagnosis or treatment
• Advertising or promotion of products or services
• Illegal content under any applicable jurisdiction

6.3 Moderation: Yayika may remove content that violates these rules at any time, without notice and without liability.

6.4 My private Confessional: Private journal entries are stored locally on your device and in Supabase under your account. Yayika does not access these entries except by court order.

6.5 Anonymity in The Circle: Posts in The Circle are anonymous. Yayika does not reveal participants’ identities except by court order or to protect someone’s safety.

7. Medical disclaimer

Yayika is not responsible for health decisions made based on the platform’s content. Use of the information is at your own risk.

8. Intellectual property

• All Yayika content — text, images, design, brand, modules — is the exclusive property of Edgar Apolonio Aguilera.
• Membership grants a personal, non-exclusive, non-transferable and revocable license to access the content.
• Copying, reproducing, distributing, modifying or creating derivative works without written authorization is prohibited.

9. Limitation of liability

To the maximum extent permitted by applicable law, Yayika will not be liable for:

• Indirect, incidental, special or consequential damages
• Loss of data or service interruption
• Content posted by users in the community
• Decisions made based on the platform’s educational content
• Damages arising from the use or inability to use the service

Yayika’s maximum liability will be limited to the amount paid by the subscriber in the last 3 months.

10. Automatic renewal and cancellation

Automatic renewal (negative option): Your subscription renews automatically at the end of each period (monthly or annual) at the current price, until you cancel. By subscribing you expressly accept this automatic renewal, whose terms — price, frequency and cancellation instructions — are shown to you clearly before payment, separately from other terms, in accordance with the FTC Act, ROSCA and US state auto-renewal laws.

• Cancellation as easy as signup: You can cancel anytime from your portal ("Cancel membership" button) or by writing to hola@yayika.com. If you subscribed online, you can cancel online, with no calls or extra steps.
• Renewal reminders: For annual subscriptions and where the law requires it (e.g. California, Minnesota), we will send you a reminder before each renewal.
• Upon cancellation, you keep access until the end of the period already paid; no further charges are made.
• Yayika may suspend or cancel accounts that violate these Terms. In such case, if cancellation is not due to a serious breach on your part, the 30-day Guarantee applies if relevant.

11. Governing law and jurisdiction

Estos Términos se rigen por las leyes de los Estados Unidos Mexicanos. Para cualquier controversia, las partes se someten a la jurisdicción de los tribunales competentes de la Ciudad de México, renunciando a cualquier otro fuero que pudiera corresponderles.

Para usuarias en la Unión Europea: nada en estos Términos limita los derechos que te corresponden bajo la legislación de tu país conforme al GDPR.

Para usuarias en California, EU: nada en estos Términos limita tus derechos bajo la CCPA.

11-bis. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless Yayika, its owner and contributors, from claims, damages, losses or expenses (including reasonable legal fees) arising from: (a) your misuse of the service; (b) your violation of these Terms; (c) your violation of third-party rights; or (d) content you post in the community. This clause does not apply to the extent the claim arises from Yayika's own negligence, nor does it limit non-waivable consumer rights granted by the law of your country.

11-ter. Dispute resolution and arbitration (US users)

This section applies only to users residing in the United States and does not affect non-waivable consumer rights in other countries.

• Informal resolution first: Before starting any formal proceeding, you agree to contact hola@yayika.com and give us 30 days to resolve the dispute in good faith.
• Binding arbitration: If unresolved, any dispute will be settled by individual, binding arbitration administered under the rules of a recognized arbitral body (e.g. AAA), under the Federal Arbitration Act, instead of in court, except small-claims matters which may be brought to that forum.
• Class action waiver: Disputes are resolved on an individual basis. You waive participation as a plaintiff or member in any class or representative action.
• Right to opt out: You may reject this arbitration clause by writing to hola@yayika.com within 30 days of your first acceptance of these Terms, without affecting your account.

If any part of this section is found invalid, the rest remains in effect. This section does not apply where prohibited by law.

12. Changes to these Terms

Yayika puede modificar estos Términos en cualquier momento. Los cambios materiales se notificarán por email con al menos 15 días de anticipación. El uso continuado del servicio después de esa fecha implica aceptación de los nuevos Términos.
